ఎవరికీ అర్థం కానీ తీర్పు అది!!

ఇప్పుడు ఇక్కడ మనం చెప్పుకోబోయేది కాస్త విడ్డూరంగానే అనిపించినప్పటికీ నమ్మి తీరాల్సిన విషయమే. ఓ కేసు విషయంలో భాష అర్థం కాక ఏకంగా సుప్రీం కోర్టు పిటిషన్ ను పక్కన పడేసింది. హైకోర్టు న్యాయమూర్తులు ఇచ్చిన తీర్పు కాపీని చూసి ఇదేం ఇంగ్లీష్ రా నాయనా అంటూ దానిని వెనక్కి పంపింది. భారతీయ న్యాయ చరిత్రలో తొలిసారిగా ఈ ఘటన చోటు చేసుకుంది.

వివరాల్లోకి వెళ్లితే... 1999లో అరుణాచల్‌ప్రదేశ్‌లో ఓ భూమి విషయంలో యజమానికి, కౌలుదారుడికి మధ్య వివాదం చెలరేగింది. దీంతో ఇద్దరూ కోర్టును ఆశ్రయించారు. కింది కోర్టు 2011 లో యజమానికి అనుకూలంగా తీర్పునివ్వగా, హిమాచల్ ప్రదేశ్ హైకోర్టు మాత్రం కౌలుదారుడికే హక్కు అంటూ తీర్పు వెలువరించింది. దీంతో అతను సుప్రీంకోర్టును ఆశ్రయించాడు.

ఇక కేసు విచారణకు స్వీకరించిన సుప్రీంకోర్టు.. హైకోర్టు ఇచ్చిన తీర్పు పత్రాలను చూసి కంగు తింది. అందులో రాసిన ఇంగ్లీష్ భాష ఎంతకీ అర్థం కాకపోవడంతో జస్టిస్ ఎంబీ మదన్ లోకూర్ , దీపక్ గుప్తాలు కాసేపు గింజుకున్నారు. అనంతరం కేసును పక్కన పెట్టేస్తున్నట్టు పేర్కొంటూ, తీర్పును సక్రమంగా రాసి పంపాలంటూ హైకోర్టును ఆదేశించింది. ఇంగ్లిష్‌ను ఎలా రాయకూడదో చెప్పేందుకు ఈ హైకోర్టు తీర్పు ఫర్ ఫెక్ట్ ఎగ్జాంపుల్ అంటూ సోషల్ మీడియాలో ట్రోల్స్ పడుతున్నాయి.

 

హిమాచల్ ప్రదేశ్ హైకోర్టు ఇచ్చిన తీర్పు ఇదే...

 

“(The)…tenant in the demised premises stands aggrieved by the pronouncement made by the learned Executing Court upon his objections constituted therebefore…wherewithin the apposite unfoldments qua his resistance to the execution of the decree stood discountenanced by the learned Executing Court

“However, the learned counsel…cannot derive the fullest succour from the aforesaid acquiesence… given its sinew suffering partial dissipation from an imminent display occurring in the impunged pronouncement hereat wherewithin unravelments are held qua the rendition recorded by the learned Rent Controller…”
